Terms and Conditions of Use for United States Postal Service® Informed Delivery® Mail and Package Tracking Interface - Desktop and Mobile Edition Including USPS Mail Delivery Notifications and USPS Informed Address Beta Tests as well as the Informed Offers Beta Test Conclusion
The Postal Service reserves the right to change the terms, conditions, and notices under which the Service is offered. You may review the most current terms and conditions of use at https://reg.usps.com/entreg/assets/html/informed-delivery.html . If You do not agree to, or cannot comply with, the Agreement as amended, You must stop using the Service. You will be deemed to have accepted the Agreement as amended if You continue to use the Service. The Service provides You with the opportunity to implement various USPS services and products, which may be modified or expanded in the Service from time to time. User acknowledges and agrees that his or her use of the Service, in each instance, is subject to any such changes and that User's use of the Service constitutes acceptance of such changed terms. User agrees to review this Agreement from time to time to ensure compliance with these terms and conditions.
Description of Service
The Service is an online desktop and mobile platform with the mobile version designed for web enabled mobile devices and is available in both IOS and Android App versions as well. The Service allows You to see images of Your mail set for or delivered to Your address or Post Office Box, track packages whether automatically or manually and to receive delivery alerts through a convenient dashboard that allows You to view all of Your incoming packages and images of Your mail before they arrive at Your home or Your Post Office Box. The Service contains functionality that allows You to implement various other USPS products and services, which includes but is not limited to printing labels; providing delivery instructions; holding mail; requesting redelivery. Informed Delivery's functionality allowing You to view images of mail through the dashboard or via email the morning that such mail will be delivered may not be available in all locations.
Potential Third-Party Charges or Fees & Consent to Receive Electronic Communications
BY ACCEPTING AND AGREEING TO THIS AGREEMENT, YOU CONSENT AND ACCEPT THE RISK IN RECEIVING INFORMATION VIA EMAIL AND/OR TEXT MESSAGING THROUGH THE SERVICE. SUCH ELECTRONIC COMMUNICATIONS MAY PROVIDE THE ABOVE MENTIONED SERVICES, BUT MAY ALSO CONTAIN MARKETING MESSAGES AS WELL AS REQUESTS FOR FEEDBACK FROM YOU REGARDING THE SERVICE. YOU MAY WITDRAW SUCH CONSENT AT ANY TIME, BUT IF WITHDRAWING SUCH CONSENT, SOME FUNCTIONALITY OF THE SERVICE MAY NOT BE AVAILABLE TO YOU. YOU ACKNOWLEDGE AND AGREE THAT YOUR TELECOMMUNICATIONS CARRIER MAY CHARGE DATA USAGE FEES (INCLUDING ADDITIONAL CHARGES WHEN ROAMING AS WELL AS FEES FOR SMS OR TEXT MESSAGING THAT MAY BE USED TO RECEIVE UPDATES RELATED TO THE TRACKING OF MAILABLE ITEMS) TO ACCESS THE SERVICE, AND THAT THE POSTAL SERVICE SHALL NOT BE LIABLE FOR ANY SUCH FEES AS A RESULT OF YOUR USE OF THE APPLICATION OR THE SERVICE. ADDITIONAL FEES OR COSTS MAY ACCOMPANY YOUR RECIEPT OF EMAILS SENT THROUGH THE SERVICE. YOU SHOULD CONTACT YOUR WIRELESS OR TELECOMMUNICATIONS PROVIDER FOR COMPLETE PRICING DETAILS.
Additional Products and Services
The various additional products and services available through Informed Delivery may have associated fees. In addition, some such services may have separate terms and conditions that You must agree to in order to access them. The Postal Service may modify the services available through Informed Delivery at its discretion, and may add or subtract services from time to time. The terms and conditions of such secondary services shall govern when accessing such services, and the terms of this Agreement shall apply to the use of Informed Delivery.
Functionality not Guaranteed
You acknowledge that functionality of the Service may be compromised or unavailable based on the configuration of Your system based on Your operating system, browser version as well as Your hardware or phone. Access to the Service is not guaranteed for every software and hardware configuration, and You agree that the Postal Service shall have no liability for Your inability to access Informed Delivery in every instance, or to access the various services available through Informed Delivery due to such hardware and software constraints.
Use of USPS Electronic Signature Online
The Service allows You to maintain an electronic signature on file with the Postal Service through an interface called USPS Electronic Signature Online. If utilizing USPS Electronic Signature Online, You initially will be asked to sign Your signature in a signing ceremony, and the Postal Service will store such signature for one-year. You will then have the opportunity to use the Service to apply Your electronic signature to certain items being delivered to Your home, Post Office Box or business address that require a signature. If You choose to apply Your electronic signature to an item, the item will be left in your mailbox if it fits or where you indicate in your profile if the item is too large for your mailbox. A signature will not be obtained at the time of delivery. The following items are eligible for USPS Electronic Signature Online:
You grant the Postal Service permission to retain Your signature during this time, and may be asked to repeat the signing ceremony following the expiration of current or past signature(s) placed on file. You also authorize the Postal Service to provide Your signature to others as proof of delivery. Use of Your signature for transactions is legally binding pursuant to the Electronic Signatures in Global and National Commerce Act (E-Sign Act) (15 USC Chapter 96 Pub.L. 106-229. The E-Sign Act requires the following disclosures, which You agree and consent to when performing the signing ceremony.
You are consenting to agreeing to be contractually bound for the products and services previously listed used using USPS Electronic Signature Online and are consenting to receive documentation of such transaction(s) either through the display of such information or the delivery of such information electronically. In such instances You may be asked to print or download such transactional information for Your records. Your consent permits the general use of electronic records and electronic signatures in connection with the services in which You use USPS Electronic Signature Online.
When using USPS Electronic Signature Online and choosing to apply that signature to a particular item being delivered to Your address or Post Office Box, you acknowledge and agree that You are authorizing the Postal Service to leave the item addressed to You or others in Your household, in your mailbox if it fits or where you indicate in your profile if the item is too large for your mailbox, and to include your electronic signature in a proof of delivery letter available to the sender. In such instances, You agree to release the Postal Service and the sender of the item from all liability, including but not limited to for loss or misdelivery of the package. In addition, You warrant and represent to the Postal Service that You are authorized by Your housemates to use Your electronic signature to acknowledge receipt for deliveries addressed to them.
You may request to receive and provide all transactional information and forms in paper form as an alternative to utilizing USPS Electronic Signature Online, but in such instance(s) we cannot process Your request(s) or perform the services You desire electronically through the use of USPS Electronic Signature Online. You may withdraw Your consent at any time by modifying your settings in customer registration. In each instance where You are prompted for use of USPS Electronic Signature Online, You will be given this opportunity. However, if you withdraw your consent, the Postal Service will not be able to process Your requested products or services deliverable through this interface electronically using USPS Electronic Signature Online.
You agree to download or print out any transactional information regarding Your use of USPS Electronic Signature Online when directed by the Postal Service to do so, and agree to maintain such documentation for Your records. You agree to notify us if Your contact information has changed such as Your email address so to receive any required documentation if necessary.
USPS Mail Delivery Notifications and USPS Informed Address Beta Tests
This Beta Test Agreement (the "Beta(s)") is a legal agreement that sets forth the terms and conditions for your use of the Informed Delivery service's USPS Mail Delivery Notifications and/or USPS Informed Address during the Beta Testing period. These Betas are concluded between You and USPS only, and USPS is solely responsible for the services, content, and materials provided through each of the Betas. User acknowledges and agrees that he, she or the entity You represent has accepted one or both of the Betas and You are solely responsible for and shall abide by each of these Beta terms. Participants in either of the Betas are subject to the following terms and conditions as well as the terms and conditions of USPS Informed Delivery.
Description of Betas
Participation in the Beta for USPS Mail Delivery Notifications enables You to receive real-time email notifications when Your incoming mail has been delivered to Your addresses of record. The Beta is only available in select locations. If You opt-in to receive notifications, the Beta shall last for approximately sixty days, but may be extended or shortened at the sole discretion of the Postal Service. Notifications sent as part of this Beta are solely for mail deliveries and do not include notifications when packages are delivered. Participation in the Beta for USPS Informed Address enables You to receive mail offers from companies that are provided a code instead of Your address. With Your participation in the USPS Informed Address Beta, participating companies are matched with You, but Your address information is protected, and the mailer receives a code that allows the Postal Service to deliver offers to You without any of your address information being disclosed to such mailer. This Beta is only available in select locations.
You acknowledge and agree that the Betas are tests that may not be free of errors, and You may not receive all notifications during the test period of USPS Mail Delivery Notifications Beta, and may not receive mail as part of the USPS Informed Address Beta. Being a test, You agree that the Postal Service does not guarantee the Betas, nor does the USPS assume any liability for the failure of delivery of notifications provided through the Beta or the non-delivery of mail offers set for delivery under the Informed Address Beta. You agree to hold the Postal Service harmless from any errors and non-receipt of notifications or lack of delivery during the Betas.
Evaluation and Contact during the Betas
You acknowledge and agree that aside from the typical Informed Delivery emails that You may receive, the Postal Service may send emails related to the Betas to You as a participant in one or both of these Betas, and participation in these Betas authorizes the Postal Service to do so. You agree to receive email requests from USPS to evaluate and provide feedback about these Betas, and/or direct mail surveys asking You to evaluate either or both of the Beta.
In any instance where User contacts the Postal Service regarding either or both of the Betas, User grants the Postal Service permission to use any information, suggestions, ideas, drawings or concepts communicated for any purpose by You to the Postal Service in any manner that the Postal Service chooses, commercial, public or otherwise, without compensation whatsoever. User agrees and acknowledges that all content found within the Betas, whether provided by the Postal Service, third parties, or the User, to the fullest extent permitted by law and under contract, shall be or become the property of the United States Postal Service with no restrictions in use, whether commercial or otherwise. User does not and will not have any rights to content found within the Betas.
No Unlawful or Prohibited Use
Expiration Date and Termination of Betas
These Betas or Your participation in the Betas shall automatically expire at the conclusion of each Beta, unless (i) terminated by the Postal Service in its sole and unreviewable discretion prior to its conclusion, (ii) cancelled by You in writing to the Postal Service, (iii) ordered by the Postal Regulatory Commission or a court of competent jurisdiction to terminate, or (iv) otherwise required to comply with subsequently enacted legislation requiring a Beta's termination. Either Party may terminate either of the Betas unconditionally and without penalty. USPS may terminate the Betas by either ending one or both of the Betas, removing Your access from one or both of the Betas or by providing You notice of the intent to terminate. You may terminate your participation in these Betas at any time by either notifying the Postal Service in writing or discontinuing use of the Betas. In the event that You terminate your participation in the Betas, the Postal Service shall have a commercially reasonable time period to remove you from the Beta you have withdrawn from; however, You acknowledge and agree that You may continue to receive updates, emails or correspondence related to one or both of the Betas until removed from one or both of the Betas. In the event the Postal Service makes the either Beta a permanent service following the Betas, Your continued use of the service will constitute Your acceptance of the permanent service's terms and conditions, which shall differ from the terms and conditions of these Betas.
Conclusion of Informed Offers Beta Test
The Informed Offers beta test has concluded; however, the Postal Service reserves the right to re-institute the beta test or to expand the test. In the event of such re-institution or expansion, these terms and conditions shall be amended to include the terms in which this service will be offered. The Postal Service, in accordance with the terms and conditions that You may have opted into to participate in the Informed Offers beta test, may continue to send you additional surveys, either electronically or via U.S. Mail in order to complete our evaluation of that beta test, and such correspondence may include offers to participate in other beta tests or to enroll in other products and services provided by the Postal Service.
User acknowledges and agrees that due to the unique nature of Postal Service's proprietary information, including but not limited to information obtained from the Betas or any USPS Marks, there may be no adequate remedy at law for any breach of its obligations hereunder these Betas, that any such breach may allow User or third parties to unfairly compete with Postal Service resulting in irreparable harm to Postal Service, and therefore, upon any such breach or threat of such breach, Postal Service shall be entitled to seek injunctions and other appropriate equitable relief in addition to whatever remedies it may have at law.
Notice Regarding Betas
Except as otherwise provided, all notices that are permitted or required under this Beta shall be in writing and shall be deemed given when delivered by First Class Mail, addressed as follows, or to such other person or address as may be designated by notice by the Postal Service:
Acceptance of Beta Terms
You acknowledge and agree that You have read, understand and accept the terms of the entire Beta or Betas You are participating in and You represent and warrant that You are authorized to accept these Betas terms and conditions with the requisite corporate power to bind Your business or You individually to perform the obligations hereunder. Your continued use of Informed Delivery and participation in one or both of the Betas constitutes acceptance of these terms and conditions.
Intellectual Property - License Grant and Restrictions
This Service provided to You by the USPS is for User's personal or commercial use. User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service excepting Your right to share information provided through the Service to explain or effectuate a Postal Service transaction (for example, sharing tracking information with a customer). Material provided by the Service is the copyrighted property of the Postal Service. All rights reserved. The intellectual property and images presented through the Service may not under any circumstances be reproduced or used without USPS's prior written permission. Other than the actual information related to a mailed item, You may view and download material from this Service for personal and commercial use solely when the materials clearly state that these materials may be copied and reproduced according to the terms stated on the particular pages where such materials are found; or with the express written permission of the Postal Service. In all other cases, You will need written permission from the Postal Service to reproduce, republish, upload, post, transmit, distribute or publicly display material from this Service.
You agree that You will not:
As between You and USPS, You acknowledge that USPS owns or has a license to all title and copyrights in and to the Service. All title and intellectual property rights in and to the content in the Service is the property of the respective content owner (whether the USPS or a licensor to the USPS) and may be protected by applicable copyright or other intellectual property laws and treaties and subject to use restrictions under such laws or treaties.
The Service and the applications found on usps.com contain the trademarks, service marks, graphics and logos of the USPS and may contain third-party trademarks, service marks, graphics, and logos. You are not granted any right or license with respect to such USPS trademarks or the trademarks of any third party available through the Service.
Updates, Maintenance and Support
USPS may from time to time make available to all users of the Service updates at no cost or subject to additional fees in USPS's sole discretion. "Updates" means any updates, upgrades or error corrections to the Service USPS makes available generally to users of the Service. Notwithstanding anything else contained in this Agreement, USPS will have no obligation to continue producing or releasing new versions of the Service or any updates thereto. USPS is solely responsible for providing any maintenance and support of the Service as specified in this Agreement, or as required under applicable law.
Links to Third-Party Sites and Limitation of Liability
The Service and other websites and services that may be accessible through the Service or on usps.com generally, which also may be operated by the Postal Service, may contain links to websites operated by parties other than the Postal Service. Such links are provided solely for User's convenience. The Postal Service does not control such third-party websites and is not responsible for the contents of such sites. The Postal Service's inclusion, if any, of links to such third-party websites does not imply any endorsement of the material on such sites or any association with their operators. When linking to such third-party websites, the Postal Service follows web-linking and exit page guidelines as set forth in USPS Management Instruction AS-610-2012-3. The Postal Service does not monitor websites linked to by User, and the use of any such links is performed strictly at the User's own risk. IN NO EVENT SHALL THE POSTAL SERVICE BE LIABLE FOR ANY DAMAGES THAT RESULT FROM ACTIVITY OCCURRING ON NON-POSTAL SERVICE WEBSITES WHEN A USER LINKS TO SUCH SITE FROM THE SERVICE OR USPS.COM.
No Unlawful or Prohibited Use
User agrees that when using the Service or usps.com that User shall not:
The Postal Service reserves the right to terminate User's access to the Service at any time without notice for any reason whatsoever.
The Postal Service reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Postal Service's sole discretion.
User grants the Postal Service permission to use any information, suggestions, ideas, drawings or concepts communicated through the Service or usps.com for any purpose by You to the Postal Service in any manner that the Postal Service chooses, commercial, public or otherwise, without compensation whatsoever. User agrees and acknowledges that all content found within the Service, whether provided by the Postal Service, third-parties or from User, to the fullest extent permitted by law and under contract, shall be or become the property of the United States Postal Service with no restrictions in use, whether commercial or otherwise.
The information, software if any, products, and services included through this Service may include inaccuracies or typographical errors. Changes are periodically added to the information provided. The Postal Service and/or its respective suppliers may make improvements and/or changes to this Service, usps.com and accompanying services available through Informed Delivery at any time.
You acknowledge and agree to indemnify and hold the Postal Service, its affiliates, officers, employees and agents, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of Your use of the Service and usps.com or in the event of Your violation of this Agreement; any infringement of third party rights by You while utilizing the Service or usps.com such as any intellectual property or other right of any person or entity arising out of or related to any products or services purchased by You in connection with the Service or usps.com or offered by a third party through the Service or usps.com.
Access Restriction and Registration
The Postal Service, in its sole and unreviewable discretion, reserves the right to deny any User access to the Service, the applications or any portion of usps.com without notice. You must register for this Service, and by doing so, You warrant and represent that You have the authority to request the functions performed through the Service. You agree not to use the Service to solicit information regarding any shipments of which You are not either the bona fide recipient or sender. The Postal Service may use a third party identity proofing company during the registration process in order to better ensure Your right to receive information at a specified location or Your right to receive information regarding the delivery of Postal Service products or services. You may be required to provide specific information to prove Your identity during this process. In addition, the Postal Service may determine Your eligibility to participate in Informed Delivery by utilizing an analysis of Your device ("Device Reputation") to determine if You are the individual you purport to be. You acknowledge that failure to provide such information or failure to allow for an analysis of Your device through Device Reputation analysis may result in the Postal Service's inability to allow You to access Informed Delivery.
The Postal Service's performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement is in derogation of the Postal Service's right to comply with governmental, court and law enforcement requests or requirements relating to Your use of this Service or information provided to or gathered by the Postal Service with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between the User and the Postal Service with respect to this Service and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and the Postal Service with respect to this Service. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Specific Provisions for the USPS® iPhone® App
This Agreement is concluded between User and the Postal Service only, and not with Apple, Inc. ("Apple®"). In addition, the Postal Service, not Apple, is solely responsible for the products and services provided by the United States Postal Service such as the Service and the Application as well as content thereof. User and the Postal Service acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon Your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against You as a third-party beneficiary thereof as set forth in App Store's Terms And Conditions available online at http://www.apple.com/legal/itunes/appstore/us/terms.html. Accordingly, that upon Your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against You as a third party beneficiary thereof. You and USPS agree that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Subject to the terms of this Agreement, User agrees and acknowledges that the Postal Service, not Apple, shall be responsible for addressing any claims of the end-user or any third-party relating to the Application or Your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar laws.
Apple, the Apple logo, iPod, and iTunes are trademarks of Apple Inc., registered in the U.S. and other countries. iPhone is a trademark of Apple Inc.
Specific Provisions for the USPS Android® Application
You and USPS agree that the group of companies of which Google is the parent has no obligation whatsoever to furnish any maintenance and support services with respect to this Service and Application.
You acknowledge and agree that each member of the group of companies of which Google is the parent shall be third party beneficiaries to this Agreement and that such other companies shall be entitled to directly enforce, and rely upon, any provision of this Agreement that confers a benefit on (or rights in favor of) them. Other than this, no other person or company shall be third party beneficiaries to this Agreement excepting Apple, Inc as set forth above.
